Allcare Dental Sued in Ohio Federal Court



And, so the lawsuits begin.
Two former Allcare Dental & Dentures patients from Ohio have filed a federal lawsuit accusing the company of knowingly taking payments for dental services and equipment it knew it would not deliver.

In the 15-page complaint, filed Tuesday in U.S. District Court for the Northern District of Ohio, Jim Crowl of Mansfield and Gabe Williams of Dayton said they and other patients paid up to thousands of dollars for dental care they never received because the offices closed without warning.

The two are seeking class action status in Ohio and nationwide, because Allcare at one point had 58 offices in 14 states, including 38 in Ohio.
Now, watch for the bankruptcy filings by Allcare Dental and its major officers to stave off the creditors. Now, fraud, if it can be proven is exempt from bankruptcy protection. But to prove it will entail extensive litigation.

Then, will there be any assets left to divide among the patients?
